Defects of Consent Essay A defect of consent is a situation where a party’s declaration does not reflect his actual intent. This difference between declaration and intent may be caused by other parties,in order to make someone to form a contract with themselves. Fraud and Duress are this kind of defects. Roughly,fraud is deceiving someone by hiding certain facts or giving them a wrong impression/information in order to make them form a contract and duress is scaring or threatening someone to make them form a contract. If there is a difference between declaration and intent,which unintentionally resulted from the declarant,we can say there is an error. In some cases,both parties are mistaken about contract. Such defects are called â€Å"Collective Error†. In these situations,contract is formed by parties’ true intent,not according to their false statements. Error In the TCO article 30,the law states that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † Interpreting this article,we can deduce that essentiality is a key concept,since unessential errors will not affect validity of the contract. Some aspects of essential error are specified in TCO,but law does not limit cases of essential error with those articles. Unwritten states of essential error are determined by the rules of good faith. Error may occur in several ways: Error in declaration In the TCO article 31 the law sets forth: An error is deemed particularly essential in the following cases 1-Where a party intended to conclude a contract different from that to which he consented. A wants to sell 100 kilos of olive oil to B,but during the formation of the contract, A inadvertently states that he wants to buy 100 kilos of olive oil and B agrees the offer. -Where a party has concluded a contract relating to a subject matter other than the subject matter he intended. A is a nanny who wants to raise B’s child C,but during the formation of the contract she stated the name of B’s mentally deficient child D. A is mistaken about someone’s identity,not someone’s qualifications. Otherwise it would be error in motive,which shouldn’t be confused. 5- Where a party has promised to make a significantly greater performance or has accepted a promise of a significantly lesser consideration than he actually intended. Error in calculation of a simple nature do not affect the validity of the contract;but they should be corrected. Error by Considering a Demeanour as Consent When a party’s action is considered as an offer or acceptance by another party,and the other party is right to consider this as such and forms the contract,contract will be valid. However mistaken party can put forward that he is mistaken and benefit from the provision of error in declaration. Texts signed without reading If a party signs a text without reading ,and is right to think that the text suits his intent,outcome is determined by the other party’s knowledge about this intent. If the other party knows or has to know that text does not suit signer’s intent,contract will not have been formed and thus there will not be any need for provisions of error. On the other hand,if the other party does not know or have to know the signer’s intent,contract will be formed,but signing party by proving that the error is essential,can benefit from provisions of error in declaration. Signature in Blank One of the parties agree to sign in blank first,then allow other party to constitute the contract. If this contract formed later on has contents which do not suit signing party’s actual intent,he can benefit from provisions of error. Error in Motive Error in motive is caused by an error in the formation of intent. On principle,error in motive is not essential. If there are conditions prescribed by the law,there is an essential error in motive. In TCO article 32,the law sets forth that â€Å"Error in motive is not deemed as essential unless the mistaken party deems the motive as necessary basis for the contract and it is valid regarding the business affairs in good faith. Yet this rule is not applicable unless the other party is aware of this motive† According to this article,error in motive is essential if the party deems this motive as necessary basis for the contact. This means the party is mistaken about a subject or qualifications of someone which affected his decision to form the contract. Error in material qualification,error in fact,error in legal status are examples of such mistakes. A wants to buy sculpor B’s statue but in fact the statue is a replica. In this situation there is error in material qualification. A thinks he is assigned to a job in another city,so he rents a house in that city. He made an error in fact. A purchases a land to build a house,but does not know construction is forbidden on this site. He is mistaken about land’s legal status. Also if other party is or has to be aware of the motive,error is deemed as essential. This should be determined in the present case. Avoidability In TCO art. 30 the law stipulates that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † However this is limited by TCO art. 39. The contract will be valid if the mistaken party does not abolish the contract in a year,beginning from the moment he realises his error. Good Faith Rules in Error Right to avoid is also limited by the law. The law states in TCO art. 34 that â€Å"A person may not advance error in a manner in violation of good faith. In particular, the contract is considered to be concluded in a way that the party acting in error intended, in case the other party declares his consent to be bound by that contract. † Violation of good faith mentioned in the first subsection may be like this: A person learns that he made an essential error about a contract which he concluded years ago. He wants to use his right to avoid just to damage other party. In that case he will not be able to benefit from provisions of error since it is a violation of good faith. Second subsection of this provision is particularly important. I wish to give a case in this point,in order to better explain it: A wants to buy a kilo of fruit for 2 Liras,but he is mistaken and accepts B’s offer to buy a kilo for 3 Liras. Then A states his mistake to B,B immediately says he is ready to sell it for 2 Liras. In this situation A cannot put forward that he wants to nullify the contract,since he made an essential error. The contract is formed. Error by Negligence According to TCO art. 35 â€Å"A party acting in error is liable for any loss arising from the nullity of the agreement where the error is attributable to his own negligence. However, there is no compensation if the other party knew or should have known of the error. In the interests of equity, the Court may, not exceeding the benefit of standart performance, award further damages to the injured party. † The first subsection is about responsibility of parties’ actions before the formation of the contract (culpa in contrahendo). Even a slightest negligence in error results in culpa in contrahendo,and in such situations damages will be compensated. According to the second sentence of this subsection,there will not be any compensations if the other party knew or should have known of the error. But this provision is not applicable to error of declaration,since if the other party knew or should have known the error in declaration,contract is formed according to the declarant’s real intent. Yet if a party knows or has to know other party made an error in motive,mistaken party will not have to compensate any damages even if he abolishes the contract. Amount of the damage that will be compensated,is the damage that would not exist if the contract would not be formed. This kind of damage is â€Å"negative damage†. Benefit of the standart performance is named as â€Å"positive damage†. According to the second subsection,judge may decide further damages. This â€Å"further damage† is compensation of positive damage. Amount of positive damage that must be compensated may be some of the positive damage or all of the positive damage,determined by equity,but cannot exceed positive damage.

There were various social, ethnic, environmental, and economic factors that made the trans-Mississippi west a unique region among the successive American frontiers. Native Americans made their last and final attempt at colonization in the trans- Mississippi west and still reside there today.Since their â€Å"Anglo† culture collided with that of Hispanic culture, the southwest remains the most Hispanicize region in America. The scale and severity of the environment brought challenges to human ambitions and the environment continued to form a social and political life. The federal government has played a massive role in the trans-Mississippi west economic and social development like in no other region. 4. There were many factors that made western farmers economically vulnerable even as they were expanding their agricultural production in the Great West.High prices had forced farmers into plating single â€Å"cash† crops and use their profits to purchase manufactured goods and foodstuffs at the general store. Large-scale farmers were entering the business world as they were becoming tied to banking, railroading, and manufacturing. They had to ay expensive machinery in order to speed up production of crops, especi ally wheat. Such widespread use of these expensive machines called for first class management. Many farmers were unskilled though, and put the blame on railroads and banks for their losses.Once farmers had stuck with the idea of single cash crops, their stability was either well or poor, when prices were high all went well and when the prices were low then farmers had to dwell on bankruptcy. 5. There were many strong points in the Farmers' Alliances as well as many weaknesses. The strongest points of the Farmers' Alliance were that the embers all agreed on the goals of the Alliance such as, the need to nationalize railroads, abolish national banks, institute a graduated income tax, and create a new federal substructures.Their crusade was an impassioned one and they seemed unstoppable as their efforts to relieve the misfortunes of the farmer were becoming noticed and unavoidable. The Farmers' Alliance weakest points were that they did not think to include more farmers that would have proved to be more useful and represent a greater and stronger organization. Its programs were only targeted at those who had owned their land. They had ignored and excluded the plight of landless tenant farmers, sharecroppers, framework's, and black farmers who made up nearly half of the agricultural population.The farmers' protests scared eastern interests so badly because they were gaining political strength, which was unwanted from the farmers of the South and West. 6. There were various actual effects of the frontier on American society at different stages of its development. Some of those actual effects of the frontier consist of ones that helped transform both the region and nation. The national character was shaped by the westward movement. The Government had set out a ban to prevent junk food from being sold to children at canteens. Mark Fraser had written a letter to a newspaper company called Community Chronicle on the 29th of October 2010 to share his disbelief at the government’s vain attempt to prevent obesity. Throughout this piece, he uses an attacking tone. He aims to target the audience of parents with children in schools to agree with him on his contention that this vain attempt will not benefit the children. Since the beginning, Fraser believes that eating habits are heavily influenced by the parents. He urges parents to take responsibility of their own children. He admits that he weighs â€Å"close to 100 kilograms† and further strengthens his statement by claiming that he is a â€Å"responsible parent.† He personalizes the statement and enables the audience to see him as a regular person and also being a responsible parent for his children despite being overweight. Fraser argues that children need to learn â€Å"self-restraint† and that parents should be responsible to make â€Å"informed decisions† for their children. He implies to the audience that a responsible parent should educate their children on their food choices. Fraser quoted Dr Peter Clifton who said â€Å"37 percent† of their daily energy intake is consumed at school, but only â€Å"14 percent† was lunch bought from the school canteen and â€Å"schools should be a focus for combating childhood obesity but strategies were needed to tackle the lunchbox, not just the school canteen.† He shifts the blame from the school cafeteria to the parents, implying that the parents should make good decisions for their children when packing for them. Fraser believes that the bans will have no impact on children’s eating habits. He begins by claiming this â€Å"strategy will not make our children perfectly healthy eaters† and † it will not encourage our kids to get out and get fit.† He implies that they’re other more effective solutions out there other than â€Å"canteen policing†. Fraser had also quoted two major principals’ associations that â€Å"young people consume at most 5 of their 21 meals a week at school† and the policy would make kids feel that â€Å"junk food is an attractive â€Å"taboo†.† He reinforces his contention by implementing the use of expert opinion, leading the audience to be more likely to believe his contention. Lastly, Fraser expresses his concern regarding the schools’ finances by stating that the â€Å"canteen is a major revenue stream for school funding.† He suggests that once the ban is put into place, sales wouldn’t be too great and there schools would lose it’s main source of revenue. Fraser also questioned whether the government would be â€Å"allocating additional funds for the revenue shortfall† He also suggested that the government might not fund the school’s revenue shortfall even if the school is affected by the ban. Fraser suggests that the ban will most likely cause major financial problems regarding the schools’ revenue steam. Fraser believed that the ban proposed by the government was merely a waste of time. He had strongly conveyed his negative opinion toward the government’s approach from the very start. He believes that children’s eating habits are majorly influenced by the parents, not the school canteen’s food choices. Fraser also believes that the bans will be off no impact toward children’s eating habits and at the same time also cause major financial problems for the school. He urges for the state government to â€Å"wake up† and see that â€Å"kids need opportunities to make their own decisions† and â€Å"stay active.†

Louis Quatorze is born on September 5, 1638, having as parents Anne of Austria and the King Louis XIII. It is not until the year of 1661 that Louis comes to the throne and governs France. Once becoming a king, Louis turns his attention towards the nobility and the church. He realizes that in order to retain absolute control over the government, he has to manipulate the nobility. In doing so, he takes from the nobility the traditional right of ruling in the government. Furthermore, Louis hires people from the upper middle class, who are paid to serve him and the state he has power over. The supervision of France is carried out by the Court of State, Court of Finances and Court of Dispatches, councils proposed by Louis. As K. K Campbell states in Louis and his Era, published in Military History, December 1997 edition, Louis court was renowned for its splendor and sophistication. The King also gains control over the Catholic Church, who had been dominant over the state previously. It is after this, that the Catholic Church losses any type of pronouncements socially, politically and economically. This way, Louis of France minimizes the power of the Catholic Church and nobility, accomplishing one of the goals of absolute monarchism. Campbell also states: What cannot be disputed is that Louis and the formidable military machine he commanded elevated France to a position of pre-eminence during his lifetime and for a century thereafter. Louis also modernizes the army of France, and puts it under the power of Francois-Michel Le Tellier. The army becomes very professional and France takes over European politics. Furthermore, no decision is made without his authority. Louis wants to centralize the government so that all decisions are made through him. Now having control over the nobility, Catholic Church and the army, Louis becomes the most important individual in France, achieving the second goal of an absolute monarchism. One of the most important things that Louis wants to do is to gain territory, power and prestige for France. The fact that the army is very modernize, makes Louis want to use it to his advantage. During his reign, Louis takes part in four major wars: the War of Devolution, The Dutch War, The War of the League of Augsburg and The Spanish War. The United provinces, Spain, England, Bavaria and Saxony joined against France, being fearful that Louis would take over Europe. Louis XIV looses the War of Spain, but remains known for introducing to Europe the New France. France is known as one of the most prestigious countries of the seventeen century, having Versailles as a symbol of French power. As Campbell also states: He helped advance the arts in every field through his enlightened patronage. Everything French was in vogue on the Continent. . The goal of gaining territory is not entirely realized, and misery is found in France in the seventeen century. As Garfield Newman states in The Wars of Louis XIV published in Legacy, The West and The World, 2002, The Grandeur of the French State was in tatters and the people were threatening to revolt, frustrated by years of war and increased taxes. It is why Louis XIV conclusively achieves gaining territory for France. It is the only goal that Louis does not fully accomplish. Last but not least, Louis XIV wants to leave behind an inheritor that can rule the state with the same goals he had during his reign. Louiss first son dies and Louis XV, his grandson, come o the throne. As K. K Campbell states : Louis XIV faced the greatest decision of his life, but he saw no choice but to put his 16-year-old grandson on the throne, grandly declaring the elimination of boundaries between France and Spain by saying, Henceforth, there are no Pyrennees. Louis XIV successfully leaves behind an inheritor, conclusively accomplishing absolute monarchism. Peter the Great is born on May 30th, 1672 and comes to the throne in the year of 1682. He is the third son of Czar Alexis Mikhailovitch. Peters first goal is to minimize the power of the Church and nobility. Peter forms what is known as the Holy Synod, which controls the decisions of the state. This way he has power over the state and the Church. Peter needs people to work for him that he could trust. As Garfield Newman states: Finding little support among the Russian elite, the czar chose to fill important posts based on merit rather than lineage or rank. This way the power of the nobility is minimized and the nobles have to go to school in order to get a job serving the state. As Anatoli Riassnovsly states in Peter the Great, published in A History of Russia, 1963, In 1722 Peter published a Table of Ranks that equated a persons social position and privileges with his rank in the bureaucracy or the army rather than with his position in the nobility. The goal of gaining control over the church and nobility is accomplished by Peter the Great, showing that is he an absolute monarch. Next, Peter wants to become the most important person in Russia and to make all decisions. Now having power over the church, army and the nobility, he has power over the state. As Garfield Newman states: Peter had over one thousand streltsy tortured and executed, and their bodies put on displayed as a lesson to the public. His wife, Eudoxia, and his half sister, both of whom had sympathized with the rebels defense of tradition and religion, were forced to become nuns. This shows the power that Peter had over anybody in Russia. Being the most important person in the state is a goal that he accomplishes. Peters first wish is to gain prestige, power and territory. He believes that he can do that by westernizing Russia. Peter himself travels to different countries of Europe with the goal of seeking different types of art and behavior. As K. K Campbell states in Another Founding Father, published in Military History, April 1999, And Oddly, as much as he brought Russia into Europe, so did he bring Europe into Russia, importing European ways and technologies, even establishing the capital at a new, western city, St. Petersburg. Peter also constructed schools such as the School of Mathematics and Navigation, and the Academy of Science. Having power over the army, Peter uses it to gain territory. As it is stated in The most Authoritative Guide to St. Petersburg found in The History of Petersburg, 2002 One of the Peters main goals was to regain access to the Baltic Sea and Baltic trade. In 1700 he started the Northern War with Sweden, which lasted for 21 years. In the course of the war St. Petersburg was founded (1703) in the Neva River delta. At the end of the war Russia was victorious and conquered the vast lands on the Baltic coast. Russia gained access to European trade and St. Petersburg became her major sea port. This shows that Peter has a lot of success in gaining prestige and territory for Russia. This goal of his career is accomplished. Peter of Russia has the power of the state, army, church and nobility. Further more he gains prestige and territory. He only goes wrong when it comes leaving an inheritor behind. As Anatoli Riassnovsky also states: Despite his notable success on the Baltic, Peters reign ended with a great question mark. He had long quarreled with his only son, Alexis. Peter was jealous of the young man and feared he might undertake sedition. In 1718 Peter had his son imprisoned and during his imprisonment, Alexis died mysteriously. This way, when Peter dies, no one comes to the throne. Years later, it is the Church and nobility that rule again. Peter fails leaving an inheritor and so the last goal of absolutism is not reached. Louis Quatorze (the Son King of France) and Peter I (the Great) of Russia are both absolute monarchs. However, their careers as monarchs are conclusively achieved due to that fact that both partially accomplish the goals of absolute monarchism. Louis of France does not succeed into gaining a lot of territory and leaves the majority of France in misery, while Peter of Russia fails to leave behind an inheritor and years later the nobility and Church takes control over the state again. Louis XIV and Peter I remain famous in the era of monarchism and in history, for it is due to their contributions that France and Russia have changed and become who they are today.

Whereas euphoria is a feeling of well-being, dysphoria is a state marked by feeling of unease or discomfort. Perhaps the most familiar type of dysphoria comes from pangs of conscience: the bad feeling in the pit of one’s stomach that results from having done something unkind or dishonest. Embarrassment is another kind of dysphoria, as is the sense of let-down that follows the euphoria felt by drug addicts and thrill seekers when the source of pleasure is withdrawn. Some psychologists have adopted the term â€Å"gender dysphoria† in place of â€Å"gender identity disorder (GID)† to describe the feelings of people who experience a sense that there’s a mismatch between their bodies and their genders. English contains dozens of words that begin with dys-. The prefix denotes the meaning of bad or difficult. Most dys- words are scientific terms, many of them dealing with pathologies. A few have entered the common general vocabulary. Here are the most commonly heard dys- words: dysentery (noun): an often epidemic or endemic disease characterized by severe diarrhea. dysfunctional (adjective): impaired, not functioning as it should. dyslexia (noun): a learning disability characterized by varying difficulties in processing written language. dyspepsia (noun): severe indigestion. Figuratively, dyspepsia, together with its adjective form dyspeptic, refers to ill humor. For example, â€Å"Then it would be dismissed as a non-issue despite the fact that invariably the dyspetic editors of The Daily Mail would turn out to be proven correct!† dysplasia (noun): an abnormal growth or development. In dogs,  hip dysplasia  is an abnormal formation of the hip socket that, in its more severe form, can eventually cause crippling lameness and painful arthritis of the  of the joints. dystopian (adjective): oppressive and miserable. The word dystopia is the opposite of utopia, a word coined to represent an ideal human society. Motion pictures that show a future in which people are oppressed by an intrusive government are said to present â€Å"a dystopian vision of the future.† dystrophy (noun): a wasting away of the body. Muscular dystrophy is a disorder characterized by progressive weakness and wasting of skeletal muscles. Freedom Ride of 1961 Essay Dear Mother, Before all else have been said and done, I want you to know that I love you more than life itself. I want to assure you that you and father make up a very good set of parents. Your upbringing made a believer out of me. Please understand that I refuse to keep quiet. I want to stand up for what I believe in and not just settle for being angry about the injustices that I witness happening around me, whatever it takes. I want to confront the barriers and overcome the sense of weakness that I feel. I do not want to be among those who would just dismiss such blatant injustices believing that they have no power to improve the situation. I want to be an agent of change. I believe that while young lives are at stake for mounting this protest, I have faith that in one way or the other, extensive media attention may be generated by the strike and the government will be ultimately forced to take action. I am offended by the manifestation of racism in our country. I believe that a group of young people have what it takes to change the system. After all, it is us who have most to gain by addressing this pressing issue. I have to admit, mother that I am afraid. I am not quite sure if I am capable enough to handle the pressure that awaits me. I fear being sent to jail at the same time as I fear the attacks of angry mobs of counter-protesters I am about to confront. However, the goal to fulfill my mission is greater than my fear. I want to prove them wrong. The youth may have the reputation of being indifferent. But then again, if the elders serve as advisors and mentors to the youth, the former would see the latter in a different light. Almost often, people lay blame on the youth for their indifference and unawareness of the things that are happening around them. But this is not always true and I want the world to know that. As I youth, I believe it is my mission to be part of a group who can supply the most innovative approach, take the most risks, at all possible costs. I am certain that we can foster positive changes through nonviolence. I hope that this undertaking could lead the way for peaceful protests led by the youth in whom the future of our nation lies. Whether you buy a green cleaning product at a store or use something on hand in your pantry, you can reap the benefits of choosing products that are gentler on you and the environment. Environment is defined as what surrounds a thing or an item or in other words it means the surrounding. It could be a physical element which is physical environment, that includes the built environment, natural environment such as air, water, land, atmosphere and etc or it could be human environment where people surrounding the item or thing which also known as the social environment. Today environment is getting worst and worst. Many environmental issues arise. Environmental concerns have been growing in recent years. One of the examples of environmen tal issue is global warming. Global warming and climate change refer to an increase in average global temperatures. Natural events and human activities such as burning garbage and waste are believed to be contributing to an increase in average global temperatures. This is caused primarily by increases in greenhouse gases such as Carbon Dioxide. The greenhouse effect keeps the earth warm when functioning normally. For the first time in history, human activities are altering the climate of our entire planet. According to (Jack, 2010), in less than 2 centuries, humans have increased the total amount of carbon dioxide in the atmosphere by 25% from the burning of fossil fuels and the destruction of forests. In addition to the natural fluxes of carbon through the Earth system, human activities, particularly fossil fuel burning and deforestation, are also releasing carbon dioxide into the atmosphere (The Carbon Cycle; the Human Role, Earth Observatory, NASA). Green product is define as a product products that produce limited carbon footprints; they may require fewer resources to produce, consume less energy or emit fewer hazardous emissions.  Green product is also a product that is non toxic, water-efficient, and also recyclable and biodegradable. There are many green products that have been produce for people in the market. For example household cleaner. Phosphate-free dishwasher and laundry detergents are green because they do not discharge environment-damaging phosphates into waterways. Other examples of green cleaning products are those labeled certified biodegradable; these have passed several stringent tests relating to biodegradability and environmental impact conducted by an independent certifying agency. According to Consumer Reports, the certified biodegradable label is more meaningful than a general biodegradable label. Glass and metal cleaners, kitchen and bathroom cleaners, and laundry detergents are products that might car ry this label. According to EPA (Environmental Protection Agency) research, the air inside the typical home is on average 2-5 times more polluted than the air just outside its walls. For the most part, indoor air pollution is created by the use of toxic chemical products like household cleaners. An EPA report stated that indoor air pollution is one of the nations most important environmental health problems. The EPA also concluded that household cleaners are 3 times more likely to cause cancer than air pollution. Walk down the cleaning product aisle at the supermarket and notice the strong toxic odors, even though the packages are tightly sealed so they cannot leak. Those same vapors remain in a well sealed home. A 15 year study compared women who worked outside the home and those who did not. They found a 54% higher death rate from cancer in the women who stayed home. The study concluded that the increased death rate was due to daily exposure to hazardous chemicals found in ordinar y household products. What is not being reported are the slow poisonings that occur in every home from continual exposure to household cleaning chemicals. A report by the Consumer Product Safety Commission found that 150 chemicals commonly found in homes have been linked to allergies, birth defects, breast cancer, testicular cancer, prostate cancer, declining sperm counts, and psychological abnormalities. Generation Y are the cool generation, they embrace brand and live in the new world of digitize communication. Thus that might be interesting to find their perception and their level of awareness towards environmental issues that the world is facing nowadays. Gen Y has grown up in a very structure, busy and over planned world. Also, Gen Y is made up of confident, optimistic young people who feel valued and wanted. In a article of science daily, Gen-Y is a people that will go all the way when it comes to saving the environment as long as it benefit to world economic and environment. They are maturing into a pragmatic generation that wants to do the right thing for the environment but also has real economic concerns PROBLEM STATEMENT Consumers or practically customers are the sellers and buyers that boost the countrys economy. Therefore, many firms are actually putting many efforts in order to attract more customers because these customers create businesses opportunities and generate profits to them. As the world nowadays facing so many problems regarding to a environmental issue, the consumers and their attitudes or behaviors to purchase a green product are the important factors to be considered. Consumers nowadays have more choices due to the effects of globalization. They will prefer the function of the product rather than the brand or whatsoever to ensure a healthier future. Gen-y is a new generation and It is crucial to understand as they are more advance and modernize. Thus, several researches have been conducted in order to understand consumers in a way that how they behave, and what are the factors that cause them to behave or react to the responses of the products. Leading factors such as price and quality are always the top concerns to the consumers. Product attributes will moderate the effects of price on quality judgments. Partial of the consumers may focus on buying low prices goods and neglect the quality of the products. This group of consumers takes the price as a measure of sacrifice. For instance, consumers take the price served as the benchmark for comparing utility gains from the quality of the product. One the other hand, some portion of the consumers will be willing to pay a premium price for the quality and function of the products, as they are very sensitive to the signals of the quality of one product. Thus, it is hope that this stud y will contribute further to the understanding of factors of price and quality that may lead to the consumers prefer for a green product * To understand the awareness level of people about Go Green campaign. Nowadays, there are many environmental campaign have been organized by a government and private sector. This campaign is aim to encourage people to more concern about the environment. Thus ,it is hope that this study will explore how people react to a environmental campaign and what is their level of awareness about the awareness campaign. * To examine the benefit for people involvement in Go Green program. We might be asking, how we will benefit from getting involved in this environmental campaign. Well, recently there has been an increase in events directly related to the availability of natural resources. For example energy shortages that resulted to load shedding, change in weather patterns and water shortages. As a result, civil society is recognizing the need to manage our natural resources more effectively and responsibly. In doing so, we can ensure positive effects on our health, quality of life and even the cost of living. Thus, this study will help people to getting known more about what they will gain if they participate in the environmental campaign. *To discover what consumer perception towards green product green product. Obviously, when we talk about green product, the price for that particular item might be so expensive. The study on factors affecting consumer especially Gen-Y buying a green product may allow us to know in depth why are previous efforts taken does not produce as it is thought it would be. Based on the study conducted, motivations towards the environment, knowledge on green product, social norm, awareness and self-image have an impact on the consumer especially Gen-Y buying a green product. New and more interesting Go Green program and method is a definite necessity in motivating people to increase their interest/awareness on a green product and indirectly motivates them to purchase it. 1.5 SCOPE OF STUDY The research focus on students in Multimedia University (MMU) Melaka campus which comes from various demographic backgrounds such as the faculty, ethnicity and nationality. The focused respondents are a great resemblance on the exact population in Malaysia. 1.6 ORGANIZATIONAL OF RESEACH 1.6.1 Chapter 1: Introduction Regarding this chapter, it introduce the background of this research such as why do people trade in order to get imported goods from other country. Thus, this will create a preference among the consumers locally and abroad to consume and purchase foreign made products. These sections will explain in details in the of consumers preferences from the Malaysian perspective and as well from the global view for foreign made products. This chapter also recognized the problem statement and the research objectives for this research. Finally, the justification of the research will help to justify the benefits and those who will gain in this research. Chapter 2 : Literature Review A thorough study will be conducted on the dependent variable and independent variables. The main purpose for this chapter is to weigh the pros and cons of the topic and to discuss in details on the ideas and knowledge concerned. In this chapter, every definition of the dependent variable and independent variables will be cited from the journals in order to strengthen every point mentioned. Several of arguments and various points of views from different authors in order to provide a stronger formation of each point can be founded in this chapter. Chapter 4 : Data Analysis After questionnaires are collected from all the respondents, then few tests will be conducted to test on the validity and reliability of the results. Whereas the tests that will be carry out are to analyze the responses from the respondents so that it will derive to a stronger conclusion at the end of this research. Chapter 2 Literature Review In a general definition, green product is known as an ecological product or environmental friendly product. Shamdasami et al., (1993) in their research defined green product as the product that will not pollute the earth or deplore natural resources, and can be recycled or conserved. Green product is a product that has more environmentally sound content or packaging in reducing the environmental impact (Elkington and Makower, 1988; Wasik, 1996). In other words, green product refers to product that incorporates the strategies in recycling or with recycled content, reduced packaging or using less toxic materials to reduce the impact on the natural environment. Krause (1993), found that consumers will becoming more concerned about their habits and the impact on the environment. The consequence of this is that some of the consumers translated their environmental concern into actively purchasing green products commitment (Martin and Simintiras, 1995). Todayà ¢Ã¢â€š ¬Ã… ¸s teenagers are c oncerned about environmental problems (Lyons Breakwell, 1994; Lee, 2008). Studies have shown that youth are more concerned and more informed about environmental problems than the adults (Van Liere Dunlap, 1980; Diamantopoulos, Schelemilch, Sinkovics, Bohlen, 2003), and teens who consider they to be knowledgeable about environmental issues tend to report higher levels of concern (Lyons Breakwell, 1994). There are many reasons and factors that affect consumer especially Gen-Y to buy a green product. Concern for the environment is perceived to be important in encouraging consumer to participate in green program and also buying a green product. Research finding suggest that, moral concerns determine several curtailment behaviors (Goldstein et al., 2008; Hage et al., 2009; Thà ¸gersen, 1996). However, studies on the influence of moral concerns on consumer high involvement buying decisions with environmental implications are rare (Thà ¸gersen, 1999). This is a problem since overlooking an influential determinant might hinder or delay successful diffusion of environmentally friendlier products and innovations. Other researcher also revealed that despite expressing concern towards the environment the consumers were unwilling to purchase or pay a higher price for environmentally friendly products (Jay, 1990; Ottman,1992; Schlossberg, 1991). A more recent report by the RoperASW (2002) prod uced somewhat disappointing results with overall environmental concern among the general population on a decline with 59 per cent of the general population not even thinking of participating in environmentally friendly activities. Kristensen and Grunert (1991) said the levels of general environmental knowledge among consumers have increased significantly over recent years. This may have been expected, since a number of new green product lines have been introduced in a market. (Bohlen et al., 1993). Knowledge and attitude towards environment are very important to influcence consumer especially Gen-Y To buy a green product. There is a general belief among the researchers and environmental activists that through purchasing environmentally friendly products or green products, products with recyclable packaging or properly disposing of non-biodegradable garbage, consumers can contribute significantly to improve the quality of the environment (Abdul-Muhmim, 2007). The quality of the environment depends critically on the level of knowledge, attitudes, values and practices of consumers (Mansaray and Abijoye, 1998). Attitudes are the most consistent explanatory factor in predicting consumers willingness to pay for green products (Chyong et al., 2006). This means that price is not the main factor in preventing consumers from purchasing green products if they are pro-environment. Researcher also found that Influencing consumer behaviour is a complex and difficult task requiring knowledge of its determinants. consumer knowledge and attitudes are determinants of behaviour (Engel et al., 1993), many researchers have attempted to understand the relationship between purchase behaviour and knowledge /attitudes. The studies from those by Arbuthnott and Lingg, (1975); Geller (1981); Maloney and Ward (1973); Muller and Taylor (1991); and Schahn and Holzer, (1990) have shown that environmental knowledge has little impact on purchasing behaviour. However, Dispoto (1977) concluded that environmental knowledge was a good predictor of environmentally sensitive activity. Grunert (1993) found that knowledge of the benefits of a green products use on the environment may have an impact on whether or not that product is purchased and used. Arbuthnott and Linggs (1975) in a study of environmental behaviours, knowledge and attitudes, suggested that environmental knowledge acts as a mediating variable for environmental attitudes and behaviour. Synodinos (1990) stated that more positive a ttitudes may result by increasing knowledge about environmental issues (p. 168). Cohen (1973) found that groups of students who were taught courses with a high environmental content, i.e. were given more environmental knowledge, had different attitudes toward the environment than the control group who were taught courses with a low environmental content. Maloney and Ward (1973) found that the attitude of consumers towards environmental protection was significantly more positive than their knowledge of environmental problems. They also stated that despite its current popularity, the average person appears to know very little about ecology (p. 585). Dispoto (1977) made similar conclusions, stating that subjects à ¢Ã¢â€š ¬Ã‚ ¦ were more emotionally involved with the environment that knowledgeable about it (p. 457). When translating these results into the context of green product lines, these findings would suggest that consumers will have a positive attitudes towards green product lin es without actually knowing how they impact on or preserve the environment. Certain theorists believe that personal norms are the attitudinal factor seen as closest to actual behavior. In relation to green activities, the personal norm reflects a moral obligation to act in an environmentally responsible manner. A key assumption is that personal norms develop through the formation of a consistent personal value system that also incorporates social norms. Several researchers have found personal norms to accurately predict green consumer behavior. Studies have also investigated the effect social influence has affect consumer especially Gen-Y purchase green product.The interest in green initiatives is not expected to emanate only from external impositions and inducements but also from the internal sense of responsibility of a firm towards the society in which it exists. For green issues, such sensitivity is intensified by increasing environmental problems such as global warming and pollution. Such problems may also raise awareness and interest of a firm to behave in a more socially responsible manner and reflect an image of due diligence and commitment to sustainability. Green purchasing is primarily motivated by a certain degree of consumer ecological consciousness. Frey and Stutzer (2006) identify a number reasons behind environmental motivation: intrinsic motivations, altruism, internalized norms and social norms. Social norms lead individuals to take into consideration the opinions of the other members of society when choos ing a green product over another: if they think that their acquaintances approve of green product purchase and disapprove of standard product purchase, there are encouraged to buy green products. (Ewing, 2001) Social norms are an important motivator of ecologically responsible behaviour The strength of the normative influence of the consumers family and social groups on purchasing decisions depends on the characteristics of the product (e.g. luxury rather than a necessity, publiclydisplayed or used in private), the susceptibility of theindividual consumer and the coercive power of the group to which the consumer belongs (Hoyer and MacInnis, 2004). Self image is the conception one has of oneself. Study in marketing influence on consumer purchase decision on green product, self-images was influencing green behaviours. Importance Of Continuing Professional Development Essay

Continual professional development is improving ones skill and abilities benefiting the individual and the organisation. It is also taking responsibility for ones learning. In these changing times where most people no longer have a job for life, learning is crucial for employability, also as business technology evolves at a much faster pace, individuals need to keep up to date with latest way of doing things – CPD can help to achieve this. My development needs There are different means by which you can develop your skills, knowledge and behaviours, for instance by accessing the Cipd website, reading daily alerts, resourcing journals online and by attending Cipd events I am able to keep up to date with current issues across the sector. I have already started to do this, and have booked myself onto some of the Cipd events. I can improve my knowledge by planning time to go through financial and reporting systems that my organisation uses, with my line/ store manager. I can also research the company intranet, as it contains a wealth of information. By attending ‘Vision’ courses in my workplace I start to think about my personal behaviours, such as self-awareness, which in turn can help me be a better role model for others. I have an interest in performance and reward management and so I am looking forward to the module on this, I will also be having a thorough look at this in my workplace, and also plan to look into performance an d reward that our competitors offer. CPD is important to me for the following reasons,  1, to enable me to improve my skill set making me more employable across the sector. 2, to help build my self-confidence, in a competitive job market. 3, to enable me to be aware of current goings on within the sector. 4, It will make me a more knowledgeable individual which will in turn benefit my team and organisation. Development Options There are many different ways of meeting continued professional needs, and different tools that can be used to help learning, these include reinforcement theories, cybernetic and information theories, cognitive  theories and problem solving and the experiential learning cycle. There are different learning style questionnaires that help people to identify which style of learning suits them, this can then be used to deliver training and learning. For example, Honey and Mumfords learning cycle suggests the following learning styles, Activist, Reflector, Theorist and Pragmatist. The VARK questionnaire is a similar tool concentrating on Visual, Aural, Read and Kinaesthetic methods of learning. In most cases people fall into more than one category, so learning styles need to be adapted so that people are able to get something out of the training. It is important to keep the training varied to account for this. Personally I prefer a mix of visual images to support my learning with some text. I also prefer to see something in conjunction with listening to a lecture, I find the visual image helps to embed the learning. It is important to be open to new styles of learning, and if I find that I am struggling with something using the internet to help find a different reports which I may find easier to understand.

Whitings Model

The motor skill example I am going to explain for each model is catching a ball in netball; there are 8 elements to Whiting’s model. The first element is the input data from display, the process which occurs in this element the player notices the display which is the environment and surroundings. The netball player would notice the ball, his teammates, opponents and spectators. This information will stimulate the sensory systems. The next element is the sense organs; the senses of vision, auditory and proprioception are used to gather information so the player is aware of what is happening around them.The player would visually see the ball and the direction of the ball, also the sense of hearing which is auditory would be used as the player would be hearing teammates talking and the coach giving instructions. The proprioceptors would be used such as touch, kinaesthetic and equilibrium to stimulate sensory receptors. The equilibrium would tell the performer whether he is balanc ed or in the right stance to be able to receive a catch. The next element is perceptual mechanisms; the information received by the sensory receptors is interpreted by making sense of the stimuli which is received.There is 3 concepts to this, firstly the detection phase where the brain identifies the stimulus present, then comparison phase which is once the stimulus is identifies, it is then compared to a similar stimuli that is stored in the schema. Lastly the recognition phase matches the stimulus to one which is stored in the memory and identified. The netball played would firstly interpret the speed of the ball and the trajectory of the ball coming to the player. Next in the translator mechanisms element, the information has been identified and interpreted so that the correct response can be put into action through the form of a motor programme.This is also the decision making phase as the movement identified leads to an action being chosen and being put in the correct order and where they will take place. The player would decide what position and stance to get into and the order of where these movements will take place. The next element is the effector mechanism where the motor programme is put into action by sending impulses via the nervous system to the muscles appropriate to the movement so the correct action can take place. The impulses would be sent to the player’s bicep and tricep brachii which would contract to get into the correct position to catch the ball.The perceptual, translator and effector mechanisms are all body boundary processes. The muscular system element is when the muscles which receive the impulses correspond and make the movements in the correct order of action. The example is the same for the effector mechanism where the impulse to the tricep and bicep brachii contract leading to the movement taking place. The output data is the end product itself so the netball player makes the catch or could drop the catch this then leads to the display changing and creates new information which is feedback after the motor programmes have taken place.Lastly the feedback data is received from intrinsic feedback which is internal sources such as proprioceptors which use the kinesthesis of the movement about whether it feels good. The other type is extrinsic feedback which is external sources such as teachers or coaches telling the player which are received by the auditory and visual systems, an example would be whether the catch felt good if the proprioceptors have a good feel for the movement.

Teachers can explain in detail to their students how to remain safe on the internet and how to utilize it to its fullest ability.
